What?
Expert deployment of the successful mediation process. Tim Wallis or Frances McCarthy will mediate in any dispute where he or she believes their skills are applicable and a successful negotiated settlement is achievable. Their CVs (see The Mediators) give details of their qualifications and experience.
When choosing a mediator some parties think it is important to select someone who has a wealth of experience in the subject matter at the centre of the dispute. Others believe it is more important to find a good mediator and that mediation skills are the most important criteria. Either way, these two skilled and experienced professionals, acknowledged by their peers as fit to represent them, have demonstrated expertise, integrity, and diplomacy. They have also repeatedly shown the capability to help achieve successful outcomes as well as earn the respect of a wide spectrum of interests in the legal, insurance and business communities. It is a matter of record that, during the difficult and often sensitive costs mediations sponsored by the Civil Justice Council, the independence and neutrality of the mediators was never questioned.
Expedite Resolution is committed to a facilitative style of mediation, where the parties reach their own settlement, rather than a directive or evaluative approach.
For most disputes parties will appoint a single mediator. Tim and Frances will, however, be prepared to act as co-mediators in appropriate areas such as government/industry disputes or multi party/class actions of particular complexity.
Where?
In England or further afield. Expedite Resolution can make mediation rooms available in London, Tyneside and Cumbria (see Procedure). Similar arrangements can be made in other locations.
When?
See Availability for dates when mediations could take place. A mediation can (if necessary) often be arranged at a week’s notice, or less, subject to availability.
Why?
Why not? It is rare for repeat litigants/litigators to try mediation and not come back. More usually they find it is a successful process and use it again.
How Much?
See Fees. Alternative arrangements are available by negotiation, eg three hour mediations, eg telephone and online mediations.
How?
Phone or e mail Expedite Resolution, print and complete the Mediation Booking Form or complete the Online Mediation Booking Form. Expedite Resolution will make all arrangements (including proposing mediation to the other party/parties where appropriate).
